Independent expert witness work

Surface Performance's senior engineers are regularly instructed as expert witnesses in slip resistance disputes — for claimants, defendants, and on a single joint expert basis. Reports are produced under the Civil Procedure Rules Part 35 and the accompanying Practice Direction, and follow the standards set by the Academy of Experts and the Expert Witness Institute.

What does the engagement look like?

A typical instruction proceeds as follows:

  • Initial review of the pleadings, witness statements, photographs, and any earlier expert evidence;
  • Site attendance to inspect and test the floor in dispute, where access is permitted;
  • Review of the cleaning regime, environmental conditions, and any product or treatment history;
  • Production of a CPR Part 35 compliant expert report addressing the issues posed in the letter of instruction;
  • Where required, attendance at experts' meetings, joint statement preparation, and oral testimony at trial.
